Employees exposed at or above the action level must be included in a hearing conservation program. That program includes noise monitoring, employee notification, audiometric testing, suitable hearing protectors, training, and recordkeeping.
The employer must also make hearing protectors available at no cost to employees exposed at or above 85 dBA as an 8-hour TWA and provide a variety of suitable options.
90 dBA: General-Industry Permissible Exposure Limit
For general industry, 90 dBA as an 8-hour TWA is OSHA’s permissible exposure limit. When exposure exceeds the limits in the standard, employers must use feasible engineering or administrative controls. Hearing protection is required when those controls do not reduce the exposure enough.
OSHA requires hearing protectors to reduce exposure to at least 90 dBA as an 8-hour TWA. For employees who have experienced a standard threshold shift, the protector must reduce exposure to 85 dBA or below.
When Must Employees Actually Wear Hearing Protection?
In general industry, hearing protectors must be made available at 85 dBA, but OSHA does not require every employee to wear them solely because the action level has been reached.
Under the federal general-industry standard, the employer must ensure hearing protectors are worn when:
- Employees are exposed above the permissible limit and engineering or administrative controls do not reduce the exposure enough.
- An employee exposed at or above 85 dBA has not yet had a baseline audiogram established within the required period.
- An employee exposed at or above 85 dBA has experienced a standard threshold shift.
- A stricter employer, customer, project, facility, state-plan, or site policy requires their use.
Many employers require hearing protection throughout designated high-noise areas even when the federal rule would not independently require every employee to wear it at exactly 85 dBA. A written company policy may be more protective than OSHA’s minimum.
OSHA Construction Hearing Protection Requirements
Construction work is covered by 29 CFR 1926.52 and 29 CFR 1926.101, rather than the complete general-industry hearing conservation standard.
OSHA’s construction permissible-noise table allows the following exposure durations:
- 90 dBA: 8 hours
- 92 dBA: 6 hours
- 95 dBA: 4 hours
- 97 dBA: 3 hours
- 100 dBA: 2 hours
- 105 dBA: 1 hour
- 110 dBA: 30 minutes
- 115 dBA: 15 minutes or less

Federal construction rules do not use the same 85 dBA hearing-conservation action level found in the general-industry standard. State-plan requirements, project specifications, or company policies may be more stringent.
Noise Exposure Is Based on Level and Duration
Noise exposure is cumulative. Employees may work around several tools or machines at different sound levels during the same shift. The combined exposure must be evaluated rather than judging each task independently.

- Different tasks and tools used throughout the shift

The program includes:

Choosing the Right Hearing Protection

The best hearing protector is one that provides adequate attenuation, fits the employee, works with the other required PPE, and is worn correctly for the full exposure period.
Disposable Foam Earplugs
Foam earplugs can provide high attenuation when they are rolled, inserted, and allowed to expand correctly. They are compact and practical for continuous noise, but poor insertion can substantially reduce protection.
Reusable Earplugs
Reusable plugs can be convenient for employees who enter and leave noisy areas throughout the day. They should be cleaned, inspected, stored properly, and replaced when worn or damaged.
Banded Earplugs
Banded protectors are easy to put on and remove during intermittent exposure. Their actual attenuation and fit depend on the band position, ear-canal seal, and manufacturer’s instructions.
Over-the-Head Earmuffs
Earmuffs are visible and generally easier to verify from a distance. They may work well where earplug fit is difficult, but the ear cushions must seal against the head. Eyeglass temples, hair, hats, hoods, respirator straps, and other PPE can reduce that seal.
Helmet-Mounted Earmuffs

What Does NRR Mean?
The Noise Reduction Rating shown on hearing-protector packaging is a laboratory-based rating used to help estimate attenuation. It is not a guarantee that every employee will receive that exact reduction in the field.
Actual protection depends on:
- Correct product selection
- Individual ear and head shape
- Proper insertion or cushion seal
- Training and practice
- Condition and cleanliness of the protector
- Compatibility with other PPE
- Consistent wear throughout the exposure
OSHA requires employers to evaluate attenuation for the specific noise environment. Appendix B to 29 CFR 1910.95 provides accepted NRR methods based on the measuring equipment used.
For an A-weighted exposure measurement, the OSHA Appendix B method subtracts 7 dB from the labeled NRR before estimating the protected exposure. The old shortcut of simply dividing the NRR by two is not the complete Appendix B compliance method.
Because field fit varies, hearing-protector fit testing can provide a personal attenuation rating and help identify employees who need a different protector or additional fitting instruction. Employers should still ensure their compliance evaluation follows OSHA’s accepted method.
Can Hearing Protection Reduce Too Much Noise?
More attenuation is not always better. Excessive protection can make communication and warning signals difficult to hear and may cause employees to remove their protectors.
NIOSH recommends selecting enough protection to reduce exposure to approximately 75–85 dBA when practical. Selection should balance attenuation with communication, situational awareness, comfort, and consistent use.
Electronic level-dependent earmuffs and communication-rated hearing protectors may help in certain environments, but only products labeled with an NRR should be treated as hearing protection. Consumer noise-canceling headphones are not a substitute unless they are specifically rated and selected for occupational hearing protection.
When Is Double Hearing Protection Needed?
Federal OSHA does not state that dual protection automatically becomes mandatory at exactly 100 dBA for every workplace. The employer must determine whether the selected protection provides adequate attenuation for the measured exposure.
NIOSH recommends earmuffs worn over earplugs for exposure at or above 100 dBA or for impulsive sounds. Dual protection may also be needed when one device cannot reduce exposure to the required level.
When earplugs and earmuffs are worn together, their labeled NRR values are not simply added. Use an accepted method to estimate combined attenuation and verify that both devices fit correctly.

Head protection, hearing protection, eye protection, and face protection must work together as a system. An earmuff that does not mount correctly or seal around the ear may not deliver the expected attenuation.
